Falling Cargo: Is the Driver or Shipper Liable?

Richard M. Ziernicki, Ph.D., P.E.

This article focuses on driver and shipper involvement in transportation.

Cargo Securement is a serious issue. Improper securement of cargo can lead to devastating consequences, not only during vehicular transportation, but also during loading and unloading cargo. Loading and unloading cargo is often more dangerous than the transport, especially when the cargo has the ability to shift or roll.

While it may seem easy enough to load the cargo and throw a number of chains or straps over the top, proper cargo securement is often a technically challenging issue.
